1. What FDS Mall is. FDS Mall is a shopping service run by FINDR. You choose items from the FDS Mall catalog, and we buy them for you and deliver them. These terms sit alongside the FINDR Terms of Service and Privacy Policy. We are responsible to you for your FDS Mall order, however we got the items and whoever was involved: for buying the items you ordered, for their condition as set out below, for delivering them, and for refunds. For FDS Mall orders, sections 2 and 16 of the FINDR Terms of Service do not limit our responsibility under these terms.
2. Using FDS Mall. You must be at least 18 to place an order. You pay in Ghana cedis; your bank sets the exchange rate and may charge fees. FDS Mall is available only in the areas shown in the app. We may refuse or limit an order, and tell you in the app. We may refuse or hold an order, and ask you to prove who you are, where the payment looks unusual, for example a large order to a person unconnected to you, repeated orders to many recipients, or a payment later disputed with your bank.
3. Price. You pay the FDS price shown in the app when you confirm and pay. It is fixed for your order. If an item costs us more than that, we pay the difference. If it costs us less, we keep the difference. The FDS price includes our concierge charge. The charge is currently about 15% on top of the price we found for the item. We do not promise the lowest price. There is one delivery fee for the whole order, shown before you pay. Any other fee is shown before you pay. You pay in the app by card or Mobile Money.
4. If we cannot supply an item. If we cannot supply an item, we tell you in the app and refund that item. If we cannot supply any of your order, we refund everything you paid, including the delivery fee and any other fee. Refunds go to the person who paid, not to the person receiving the goods. A card payment is refunded to the card. A Mobile Money payment is refunded to the Mobile Money number that paid.
5. Quality and problems. We buy goods of normal quality that match their description in the app. For goods sold loose, by weight or by measure, we cannot promise more than normal quality. If goods arrive damaged, wrong, short or not as described, tell us in the app or at support@findrgh.com, with a photo if you can. You deal with us and no one else. We do not take goods back because you changed your mind. Nothing in these terms limits any right you have under Ghanaian law that cannot be limited.
6. Ordering for someone else. You can order for delivery to another person in Ghana. That person is "the recipient". You give us the recipient's name, phone number, delivery address and map pin. You confirm that the recipient knows about the order, agrees to be contacted about the delivery (including by SMS), and that you are entitled to give us these details. You are responsible if you give us details you are not entitled to share. We share the recipient's details with the FINDR team member, rider or truck driver handling the order and the delivery partners and providers who help us complete it, only for that delivery. 7. Delivery. We deliver to the address and pin you gave. Delivery times are estimates. If the recipient refuses the goods, cannot be reached or the address is wrong, we may cancel the delivery.
8. What we do not buy for you. FDS Mall does not buy or deliver medicines, prescription or controlled products, alcohol, tobacco, fuel or gas, pesticides and other hazardous chemicals, weapons or live animals.
9. Changes, law, contact. We may update these terms. A new version does not apply to an order placed before it takes effect. We tell you in the app before a material change. These terms are governed by the laws of the Republic of Ghana, and disputes are subject to its courts. If any part cannot be enforced, the rest still applies. support@findrgh.com.
