FINDR Haul Driver Terms

For drivers who carry goods for businesses on FINDR Haul.

1. What this is

  1. These terms apply when you sign up to carry goods on FINDR Haul, register a vehicle, or bid for or carry a haul job. They sit alongside the FINDR Terms of Service and Privacy Policy. If these terms and the Terms of Service differ on a FINDR Haul matter, these terms apply.
  2. On FINDR Haul, a business posts a load to be moved and the price it will pay. You can accept that price or offer your own. If the business chooses you and pays, you carry the load from the pickup point to the drop-off point.
  3. FINDR Haul carries goods only. You must never carry passengers for payment on a FINDR Haul job.

2. Your status

  1. You are an independent operator. You are not FINDR's employee, worker or agent, and nothing in these terms creates a partnership or joint venture.
  2. You decide whether to bid for a job, which jobs to take and when you are available. FINDR does not set your hours.
  3. You are responsible for your own tax, including income tax on what you earn, any Vehicle Income Tax and any other levy that applies to you or your vehicle.
  4. You carry out each job yourself, in the vehicle that won it. You may bring someone to help you load or unload, but you are responsible for them. You may not pass a job to another driver or vehicle.

3. Who can haul

  1. To haul on FINDR you must:
    1. hold a valid Ghana driving licence of the class that covers the vehicle you drive, and give us its licence number and class;
    2. be at least 25 years old, the minimum age FINDR sets in line with the guidance of the Driver and Vehicle Licensing Authority (DVLA) for digital transport drivers, and give us your date of birth;
    3. have a good driving record;
    4. give us your true name, phone number and a live selfie; and
    5. be approved by FINDR.
  2. FINDR may ask you for a police report, or carry out other checks permitted by law, before or after approving you. FINDR may refuse or suspend you based on the result.
  3. FINDR may decline a sign-up without giving a reason.
  4. If you hold a commercial rider's licence or any other permit that the law requires for your vehicle, you must keep it valid and show it to us when we ask.

4. Your vehicle and documents

  1. You must register each vehicle you want to use, with its class, capacity, body type, number plate, pictures and the expiry dates of its roadworthy certificate, insurance and DVLA sticker. FINDR checks each vehicle before it can take jobs.
  2. You must keep every vehicle you use on FINDR Haul:
    1. registered with DVLA for the use you make of it, with its number plate showing;
    2. roadworthy, with a current roadworthy certificate;
    3. insured as section 5 requires, with the insurance sticker displayed;
    4. carrying a current DVLA sticker; and
    5. in good working order and safe for the load.
  3. A vehicle is not offered any job, and cannot win a job, while its roadworthy certificate, insurance or DVLA sticker is missing or has expired, while its insurance does not cover carrying goods for payment, or while it has no number plate. This happens automatically once the expiry date has passed. FINDR cannot override it. Renew the document and update it in the app.
  4. The details and pictures you give must be true and current. Tell us at once if a document is suspended, cancelled or changes.
  5. Goods tricycles (aboboyaa and cargo tricycles) are not offered jobs on FINDR Haul until DVLA has approved their use and FINDR switches them on. When they are switched on, they are offered only short jobs within their stated capacity.

5. Insurance

  1. Each vehicle must have motor insurance, at least third-party, that covers using the vehicle to carry goods for payment. A private-use policy is not enough.
  2. Goods-in-transit insurance covers the goods you carry. It is optional on FINDR Haul. If you have it, say so when you register the vehicle; businesses can see whether your vehicle has it before they choose you. Do not say you have it if you do not.
  3. You are responsible for any excess or claim under your own insurance.

6. Taking a job

  1. You can see haul jobs that fit one of your approved vehicles. For each job you can accept the business's price or make a bid with your price, the time you can reach the pickup point and a short note.
  2. A business may choose any bid, or none. When a business chooses you, it has a limited time to pay. If it does not pay in time, the job opens again.
  3. Until the business has paid, you may step back from the job without any charge.
  4. Before you bid, you can see the load description, the pickup and drop-off addresses, the price and any declared value. Once the business has paid, the job is booked to you. You can then see the phone number of the person who posted the haul (or the business's phone number), the pickup and drop-off points, and the receiver's name and phone number. Use them only for that job.
  5. Your price for a job cannot be more than GH₵ 20,000.

7. Pickup and drop-off codes

  1. At pickup, the business reads you a pickup code. Enter it in the app once the goods are loaded and you have checked them. Entering the code confirms that you received the load as described. If the load includes prohibited goods, do not enter the code; refuse the load in the app instead (section 10).
  2. At drop-off, when the goods are off your vehicle, ask the receiver for the drop-off code and enter it in the app. The code confirms the delivery. Only the receiver or the business should give you the code. Never enter a code you got another way, and never enter the drop-off code before the goods are handed over.
  3. After five wrong attempts on either code, the job locks until FINDR checks it. Contact FINDR support if this happens.
  4. Do every haul in the FINDR app, from booking to drop-off. Keep your phone's location on while a job is in progress so the business and the receiving shop can see where the goods are.

8. Carrying the goods

  1. Unless the job note says otherwise, the business arranges loading at pickup and the receiver arranges unloading at drop-off. You are responsible for checking that the load is safely placed and secured on your vehicle, and you may refuse a load that is unsafe to carry.
  2. You must not carry more than your vehicle is built and licensed to carry, and you must not overload it.
  3. Drive safely and obey the road traffic laws. Take the goods straight to the drop-off point without unreasonable delay.
  4. If you are delayed, have an accident or cannot complete the haul, tell the business and FINDR support at once.
  5. Treat the business, the receiver and their staff with respect.

9. Loss of or damage to goods

  1. You are responsible for the goods from the moment you enter the pickup code until the drop-off code is entered.
  2. You are responsible to the business for goods that are lost, stolen, damaged or short while in your care, unless the loss was caused by:
    1. the way the business packed, described or loaded the goods;
    2. the nature of the goods themselves; or
    3. an event outside your reasonable control that you could not have avoided by taking reasonable care.
  3. The business may declare the value of the goods when it posts the haul. The declared value is shown on the job before you accept the price or bid. Your responsibility under 9.2 for any one haul is limited to that declared value. If the business left the value blank or entered 0, it counts as not declared, and your responsibility is limited to the agreed haul price for that haul.
  4. The limit in 9.3 does not apply if you, or anyone helping you, stole the goods or caused the loss on purpose.
  5. If goods are lost, stolen or damaged, report it in the app or to FINDR support straight away, and report a theft or accident to the police. Help the business and your insurer with any claim.
  6. FINDR is not responsible for goods you carry. A claim for loss or damage is between the business and you (and your insurer). FINDR may use the money it is holding for that haul to settle a dispute, as section 13 explains.

10. Goods you must not carry

You must refuse, and must not carry, any of the following on FINDR Haul:

  1. anything illegal to own, sell or move in Ghana, or stolen or counterfeit goods;
  2. weapons, ammunition, explosives or fireworks;
  3. dangerous goods, including fuel or gas in bulk, gas cylinders, chemicals, acids, poisons and other flammable, corrosive or toxic substances;
  4. drugs, and medicines that need a licence to move, unless the business shows that it holds that licence;
  5. cash, gold, precious stones or minerals, jewellery, and cheques or other documents that can be exchanged for money;
  6. timber, minerals or other goods that need a permit or licence to move, unless the business shows you that permit;
  7. live animals of any kind;
  8. people, or human or animal remains; and
  9. any load larger or heavier than your vehicle can safely and lawfully carry.

Refusing a prohibited load at pickup. If you see at pickup that a load includes any of these, do not enter the pickup code. Refuse the load in the app, before entering the pickup code, and say why. You may add pictures. The haul is put on hold while FINDR's Haul desk reviews your refusal. If FINDR confirms it, the haul counts as cancelled by the business and you have no cancellation charge. If FINDR decides the goods are not prohibited, the haul goes back to you and FINDR asks you to collect it. You cannot refuse the same load again after that. Only if you still will not carry it does the haul count as cancelled by you under section 12.2.

If you find prohibited goods after you have entered the pickup code, stop the trip somewhere safe and contact FINDR support at once. FINDR's Haul desk deals with it as a problem under section 13 and decides what happens to the money it is holding for that haul.

11. Your pay

  1. Your pay for a haul is the price the business accepted, less FINDR's commission. FINDR's commission is currently 0%.
  2. FINDR may introduce or change a commission. We will give you at least 30 days' notice in the app before it applies. The rate in force when a job is booked is the rate for that job.
  3. When the drop-off code is entered, your pay is added to your FINDR wallet and held for 24 hours. If nobody reports a problem in that time, it becomes available and you can cash it out to your Mobile Money number in the usual way. FINDR pays the cash-out transfer fee for haul pay for now; we will give you notice before this changes.
  4. If a problem is reported during the 24 hours, your pay stays on hold until FINDR decides the problem (section 13).
  5. FINDR collects the price from the business on your behalf and holds it until it pays you under these terms. Payment by the business to FINDR counts as payment to you. FINDR does not pay interest on money it holds.
  6. FINDR Points are not earned on hauls.
  7. If FINDR pays you more than you are owed by mistake, or pays you for a haul that was not delivered, you agree to return it, or to let FINDR take it off your future haul pay.
  8. For now, once your pay has been released FINDR will not take it back, except under 11.7 or where we find fraud. We will give you at least 30 days' notice in the app before this changes.

12. Cancellations and no-shows

  1. The party that cancels a paid haul bears the payment processing fee for it.
  2. If you cancel a haul after the business has paid, or you do not collect the load by the end of the pickup time and the business cancels, the business gets a full refund. The payment processing fee the business paid for that haul becomes a cancellation charge on your account.
  3. A cancellation charge is taken off your next haul pay. It never takes your pay below zero; anything left over is taken off the haul after that. We do not ask you to pay it in any other way. If you never complete another haul, it lapses.
  4. If the business cancels a paid haul before pickup, or FINDR cancels it, you are not charged. If you refuse a load at pickup because it includes prohibited goods and FINDR confirms the refusal (section 10), the haul counts as cancelled by the business and you are not charged. If FINDR decides the goods are not prohibited, the haul goes back to you to carry; if you then still refuse to carry it, 12.2 applies.
  5. Once you have entered the pickup code, you cannot cancel in the app. If you cannot finish the trip, contact FINDR support at once. FINDR treats it as a problem under section 13.
  6. FINDR may suspend a driver who cancels or fails to turn up often.

13. Problems and disputes

  1. The business that booked the haul, or the shop receiving the goods, can report a problem during the 24-hour hold, for example goods short, damaged or not delivered.
  2. FINDR will ask both sides for information, pictures and the trip record, and will then decide whether to release your pay, refund the business, or split the money it is holding between you. FINDR's Haul desk lets both sides know what it decided. We aim to decide within 48 hours of receiving the information we need.
  3. FINDR's decision is only about the money FINDR is holding for that haul. It does not stop you or the business from taking any other legal step against each other.
  4. Answer FINDR's questions honestly and quickly. If you do not respond within 48 hours, FINDR may decide on the information it has.
  5. To raise a complaint about a business, a receiver or FINDR, use FINDR support in the app or email support@findrgh.com.

14. Suspension and removal

  1. FINDR may pause, suspend or remove your access to FINDR Haul, or stop a vehicle being offered jobs, at any time, for example if:
    1. a document has expired, your licence is no longer valid, or your details are false;
    2. you break these terms, the Terms of Service or the road traffic laws;
    3. we receive repeated complaints about you, or a serious safety complaint;
    4. we suspect fraud, including self-dealing (taking jobs from a business you own, work for or act with); or
    5. DVLA or another authority requires it.
  2. Where the law or DVLA requires it, FINDR reports drivers who break the rules to DVLA.
  3. Pay already released to you is not affected by a suspension, except under 11.7. Pay on hold is dealt with under section 13.
  4. You may stop using FINDR Haul at any time. You cannot delete your FINDR account while a haul you won is in progress, while haul pay is on hold, or while FINDR owes you or holds money for a haul. The app tells you why.

15. Your information

  1. We store your name, phone number, date of birth, selfie, licence class and number, any police report or check result under 3.2, Mobile Money details, your vehicles' details, documents and pictures, your bids, the hauls you carry, any note and pictures you send when you refuse a load, your location while a haul is in progress, codes entered, ratings, and your haul pay and cancellation charges.
  2. We use them to check that you and your vehicles may haul, to match you with jobs, to show businesses who is coming, to pay you, to settle problems, to keep FINDR Haul safe and to meet our legal duties.
  3. Businesses see your first name, vehicle class, rating, number of hauls and whether you have goods-in-transit cover when you bid. Once a job is paid, the business and the receiving shop also see your name, phone number, plate and where the truck is. If you refuse a load, the business sees your note. FINDR's Haul desk sees your age and licence number, not your date of birth.
  4. Where DVLA requires it, we share your name, licence number, vehicle registration number and trip details with DVLA. We share your Mobile Money details with our payment provider, Paystack, only to pay you.
  5. The FINDR Privacy Policy explains this in full, including how long we keep your information and your rights under the Data Protection Act, 2012 (Act 843).

16. Liability

  1. FINDR provides the FINDR Haul app and service as it is. We do not promise that you will get any number of jobs, or that the service will always be available.
  2. FINDR is not responsible for the goods, for the acts of businesses or receivers, for fines, penalties or offences arising from your driving or your vehicle, or for damage to your vehicle.
  3. FINDR's total responsibility to you for any haul is limited to the pay that is due to you for that haul under these terms.
  4. FINDR is not responsible for any indirect loss, such as loss of other work or earnings.
  5. You agree to cover FINDR's losses and costs from any claim made against FINDR because you broke these terms or the law, or because of goods lost or damaged in your care.
  6. Nothing in these terms limits any responsibility that the law does not allow to be limited.

17. Changes and general

  1. FINDR may update these terms. We will tell you about the new version at least 14 days before it applies, unless a change is needed sooner for legal, safety or fraud reasons. When it applies, the app may ask you to accept the new version before you bid for or accept another job. You accept it by agreeing in the app or by continuing to use FINDR Haul.
  2. If any part of these terms cannot be enforced, the rest still applies.
  3. These terms are governed by the laws of Ghana, and disputes are subject to the courts of Ghana.
