FINDR Driver & Courier Agreement, Version 2

For drivers and couriers who give rides or deliver goods on FINDR.

Version 2, 14 October 2026 · Feria Information Systems (FIS), company registration number CS152800726, operator of FINDR · Read with the FINDR Terms of Service and Privacy Policy.

You accept this agreement in the FINDR app. It becomes available to riders with the app update that is coming.

This agreement is between Feria Information Systems (FIS) of University Road, Koforidua, Eastern Region, Ghana ("FIS", "FINDR", "we") and you, the driver or courier who accepts it. It sits alongside the FINDR Terms of Service and the Privacy Policy. Section 7 of the Terms of Service says that if you provide services on FINDR you are an independent operator, not an employee of FINDR. This agreement gives the detail for rides and deliveries made through one FINDR driver account.

This agreement takes effect for you on the date you accept it in the app. Version 1 stays valid. You do not have to accept Version 2 to go online, take trips or deliveries, or cash out. If you accept Version 2, it replaces Version 1 for you from the time you accept.

1. FEES (FOR NOW)

FINDR currently charges you no commission and no subscription. You keep the fares and delivery fees you earn, paid as shown in the app. FINDR may introduce a commission, fee or subscription later, but only after giving you reasonable notice in advance.

2. YOUR STATUS

2.1 You are an independent contractor. You are not an employee, worker or agent of FIS or FINDR. Nothing in this agreement creates a partnership, joint venture or employment.

2.2 You decide when to go online, which trips and deliveries to accept and which to decline, and how you carry them out. FINDR sets only the rules needed for safety, security, legal compliance and to confirm that a trip or delivery happened, for example the pickup and delivery codes.

2.3 You use your own vehicle, fuel, phone and data. You are responsible for your own tax and for the licences, permits, roadworthy certificate, DVLA sticker and insurance the law requires.

2.4 You have no authority to bind FIS or to speak for it.

3. LICENCES, VEHICLE AND INSURANCE

You confirm that you hold a valid driver's licence, that your vehicle is roadworthy and legally registered, and that you carry the insurance the law requires. You will keep these valid while you use FINDR. Your vehicle and documents must match what is on your FINDR account. You will tell FINDR at once if a document expires, is suspended or changes.

4. SAFETY

Safety of you and your passengers comes first. You will obey all traffic laws, wear your seatbelt, and not hold or type on your phone while driving. You will never drive while tired, or under the influence of alcohol or drugs. You will confirm the passenger and destination before starting, and make sure passengers are safely seated. You will not carry more passengers than your vehicle safely allows.

5. CUSTOMER SERVICE AND FAIR FARES

You will be polite and professional, keep your vehicle clean, and arrive promptly. You will charge only the fare or delivery fee shown in the app and will not demand extra cash. You will not discriminate against any passenger. Repeated cancellations, poor ratings or complaints may affect your access.

6. DELIVERIES: HOW YOU HANDLE GOODS

6.1 When you accept a delivery you will handle the goods with care. You will not open or tamper with them. You will keep food and fragile items upright, covered and secure. You will confirm the pickup code and the delivery code in the app. You will not carry illegal or prohibited items.

6.2 Check the pack at pickup. If it looks open, damaged, leaking or wrong, tell the shop and FINDR support in the app and take a photo before you leave. Do not enter the pickup code for goods you have not checked.

6.3 Do not enter the delivery code until you have handed the goods to the customer or receiver.

7. DAMAGE, LOSS AND THEFT OF GOODS YOU CARRY

Clauses 7 to 9 apply to goods deliveries only, not to passengers. They apply to a delivery only if you accepted Version 2 before you made that delivery.

7.1 FINDR is a platform that connects shops, customers and independent drivers and couriers. FINDR does not itself provide transport (section 2 of the Terms of Service) and does not guarantee any delivery. It is not liable for the acts or omissions of independent couriers (section 16 of the Terms of Service). If FINDR refunds a customer, it does so as a service to the customer under section 4 of the Terms of Service. That is not an admission that FINDR carried the goods or is liable for them. FINDR does not insure the goods.

7.2 You are responsible for the goods from the moment the pickup code is entered until the delivery code is entered. In that time you are responsible for goods that are lost, stolen, damaged, spilled, tampered with, wrongly delivered or short, unless the cause was:

(a) the way the shop packed, labelled or described the goods;

(b) the nature of the goods themselves;

(c) the customer or receiver, for example a wrong address or a refusal; or

(d) an event outside your reasonable control that you could not have avoided by taking reasonable care.

7.3 Limit. For any one delivery claim, the most FINDR can recover from you is the value of the goods lost or damaged, and never more than GH₵500. This GH₵500 limit is the limit of your liability to FINDR for that claim, even though the Terms of Service contain a general indemnity. The limit does not apply if you, or anyone helping you, stole the goods or caused the loss on purpose. In that case FINDR may recover the full value of the goods. For a Makola market order, the amount is limited to the value of the goods at the price shown. The delivery fee is not part of a claim.

7.4 If something goes wrong, tell FINDR support in the app straight away. Take a photo if it is safe. Report a theft or an accident to the police. Help FINDR and your insurer with any claim.

7.5 FINDR does not insure your vehicle or the goods. You may choose goods-in-transit insurance. You are responsible for any excess or claim under your own insurance.

7.6 If you also take jobs on FINDR Haul, those jobs are governed by the FINDR Haul Driver Terms and the Haul Terms for Businesses, not by clauses 7 to 9. FINDR does not take money from your Haul pay for damaged goods under this agreement.

8. HOW A CLAIM IS DECIDED

8.1 If a customer or shop reports a problem with a delivery, FINDR may ask you, the shop and the customer for information and photos. FINDR will also look at the delivery record, such as the codes, times and location trail.

8.2 FINDR will tell you in the app that a claim has been opened against a delivery you made. The notice says what was reported, the amount in question, what evidence is wanted, and the date by which you must answer. You have 48 hours from the notice to answer. If you do not answer, FINDR may decide on the information it has.

8.3 FINDR decides who was at fault: the shop, you, the customer, or nobody, or that it cannot tell. FINDR writes down the reason. You are told the decision, the amount and the reason in the app. A second FINDR person must also approve the decision if the amount is above GH₵150, if the claim is for theft or deliberate loss, or if the customer's whole order is refunded.

8.4 If FINDR cannot tell who was at fault, it takes no money from you.

8.5 FINDR takes nothing from you for 7 days after it tells you its decision. In that time you can ask for one review and add new evidence. A FINDR person who did not make the first decision does the review. While the review is open, FINDR takes nothing and keeps any hold in place. FINDR tells you the result in the app.

8.6 FINDR's decision is about how FINDR treats the money it handles and what it takes from your FINDR earnings. It is not a court judgment. This agreement does not stop you or FINDR from reporting a crime to the police or from taking any other legal step.

9. REFUND FIRST, RECOVERY AFTER

9.1 Where a customer is owed a refund for a delivery problem, FINDR refunds the customer first, as section 4 of the Terms of Service describes. FINDR does not wait to recover from you before it refunds the customer. How the customer is refunded is FINDR's business, not yours.

9.2 If FINDR decides under clause 8 that you are responsible, FINDR may recover the amount allowed by clause 7.3 from your FINDR earnings, as clauses 9.3 to 9.7 say. This is FINDR passing on a cost that you are responsible for. It is not a fine or a penalty.

9.3 Hold. When FINDR opens a claim against a delivery you made, it may hold part of the money available to you in the app. The hold is the smaller of the amount in dispute (never more than GH₵500, except for theft or deliberate loss) and your available balance on the day the claim is opened. Money you earn later is not held. A hold is not a deduction. You will see it in the app. FINDR releases the hold if it decides you were not responsible, or if it has not decided within 30 days of placing the hold.

9.4 FINDR recovers only from money that FINDR holds for you or owes you and has not yet paid out. This means your available balance and your future earnings. FINDR never takes your balance below zero. If the balance is not enough, the rest is taken from later earnings.

9.5 If you complete no delivery for 90 days, or you stop using FINDR, any amount still unrecovered is cancelled. FINDR will not ask you to pay it in any other way and will not send you a demand for it.

9.6 Money already paid out to you before a hold was placed is not taken back. If the hold is smaller than the claim because you cashed out first, only the amount held and your later earnings can be used.

9.7 If FINDR pays you more than you are owed by mistake, you agree that it can be taken off your future earnings.

9.8 FINDR may suspend an account that repeatedly causes damage or loss (clause 11).

9.9 FINDR keeps a record of every claim, hold, decision, review and deduction, and shows you yours in the app.

10. HONEST USE, ANTI-FRAUD AND DATA PROTECTION

You will use one account for yourself only, with accurate details. You will not share your account or manipulate trips, locations or ratings. Fraud or misuse is a serious breach. You will handle passenger and customer personal data only to complete their trip or delivery, in line with the Data Protection Act, 2012 (Act 843). You will not keep, copy, share or personally use that data, and you will contact people only through the app. FINDR keeps records of your account, trips, deliveries, claims and earnings and uses them as the Privacy Policy explains.

11. RATINGS, SUSPENSION AND ENDING THIS AGREEMENT

11.1 FINDR uses ratings, checks and reports to keep the platform safe. FINDR may suspend or deactivate your account for safety violations, fraud, invalid documents, or serious or repeated breaches of this agreement. This includes repeated damage or loss for which you were found responsible.

11.2 You may stop driving at any time. Either side may end this agreement on reasonable notice. Ending it does not cancel a claim already open, but clause 9.5 still applies.

11.3 Money already released to you is not affected by a suspension, except as clause 9 says. Money on hold is dealt with under clause 8.

12. CHANGES

FINDR may update the platform terms (see section 19 of the Terms of Service). For this agreement, FINDR will give you at least 14 days' notice in the app before a new version applies to you. If you do not accept the new version, you may stop using FINDR. A new version never applies to claims about deliveries made before you accepted it. Fee changes follow clause 1.

13. GENERAL

13.1 This agreement is governed by the laws of the Republic of Ghana, and disputes are subject to its courts.

13.2 Together with the Terms of Service and the Privacy Policy, this is the whole agreement between you and FIS on deliveries, damage and your earnings. If they differ on those matters as between you and FIS, this agreement applies. In particular, the GH₵500 limit in clause 7.3 applies even though section 17 of the Terms of Service is general. This agreement does not change what the Terms of Service say to customers or shops.

13.3 If any part cannot be enforced, the rest still applies.

14. ACCEPTANCE

14.1 You accept this agreement by typing your full name and tapping "I agree" in the app, after the full text and the summary have been shown. FINDR records your user, the version, your full name and the time.

14.2 If you accepted Version 1, Version 2 replaces it for you from the time you accept. Clauses 7 to 9 apply only to deliveries you make after you accept Version 2. If you do not accept Version 2, Version 1 stays in place for you, and no hold or deduction under clauses 7 to 9 can be made from you.
