These Terms of Service ("Terms") govern your use of the FINDR app, website and services ("FINDR"), operated by Feria Information Systems (FIS) ("we", "us"). By creating an account or using FINDR, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use FINDR.
1. Who can use FINDR
You must be at least 18 years old and able to form a binding contract. You're responsible for the accuracy of the information you provide and for activity under your account.
2. What FINDR is
FINDR is a marketplace and technology platform that connects customers with independent drivers & couriers, businesses, skilled workers, tutors & schools and landlords for rides, food & shopping, package delivery, events, stays, dine-in, property, vehicles, skilled-trade jobs, classes and everyday payments. Except where expressly stated, FINDR does not itself provide transport, goods, accommodation, events, trade services or educational content; those are provided by independent third parties, and your contract for them is with that provider. FINDR facilitates discovery, ordering, communication and payment.
3. Your account
- Sign in is by phone number and a one-time passcode; keep access to your number and device secure.
- You're responsible for activity on your account; tell us promptly of any unauthorised use.
- You may delete your account at any time (see Delete your account).
4. Orders, bookings & payments
- Prices, fares and fees are shown before you confirm. Some fares (e.g. rides) may vary with distance, time and demand.
- Payments are processed by third-party providers (e.g. Paystack, MTN MoMo). You authorise the charge for what you order, including any applicable delivery fees, service fees or tips.
- Some businesses offer pickup (self-collect) orders: you collect the order yourself instead of having it delivered. The same payment terms apply; no delivery fee is charged.
- Where you redeem FINDR credit or a promo, it is applied as a discount under the terms of that offer and has no cash value.
- Refunds, cancellations and disputes for goods and services are handled with the relevant business or provider, subject to their policy and applicable law. We can help facilitate, but the provider is responsible for fulfilment.
5. Acceptable use
You agree not to:
- Break the law, or use FINDR to facilitate anything illegal, harmful, fraudulent or abusive.
- Misuse, scrape, reverse-engineer, overload or interfere with the platform or its security.
- Impersonate others, provide false information, or infringe anyone's rights.
- Post content that is unlawful, deceptive, offensive, or that you don't have the rights to.
6. Drivers, couriers, businesses & other providers
If you provide services on FINDR, you are an independent operator, not an employee of FINDR. You're responsible for your licences, permits, taxes, insurance, the quality and legality of what you provide, and for complying with our policies. We may verify your identity and documents and may suspend or remove access for policy or safety reasons. This applies equally to skilled workers, tutors and schools, and landlords who use FINDR's tools.
7. Skilled-worker jobs (Hire)
FINDR's jobs marketplace lets customers post jobs and skilled workers bid on them, with worker profiles and ratings to help you choose. FINDR provides the venue only:
- The contract for the work is directly between the customer and the worker. FINDR is not a party to it and does not supervise or guarantee the work.
- Payment for jobs happens outside the app, directly between customer and worker. FINDR does not process, hold or escrow job payments and is not responsible for them.
- Workmanship, materials, timing and any disputes are matters between the customer and the worker. You can report abusive, unsafe or fraudulent behaviour in the app, and we may act on it under these Terms.
8. Classes & paid class access (Classroom)
Tutors and schools can post lessons and materials to a class and, if they choose, charge a price to join.
- The tutor or school is the seller and the owner of its class content; your enrolment contract is with them. Enrolment (free or paid) unlocks the class content for your account.
- Payments for class access are processed in the app and settle to the tutor's or school's earnings like other provider revenue.
- Lessons, materials and class questions & answers are user content: they must be the tutor's own work or properly licensed, and the content rules in these Terms apply to them.
9. School fees (FeePay)
- Fee payments go to the school, a third party. FINDR processes the payment and confirms it with the student reference the payer enters.
- Fee amounts, what they cover, and any refunds are the school's responsibility; confirm the amount with the school before paying. Part-payments are allowed.
10. Property listings & property management
- Landlords and sellers are responsible for the accuracy of their listings and property information.
- FINDR's property-management tools help landlords organise residents, staff and maintenance requests. FINDR is a management tool only; it is not a party to any tenancy or sale agreement, and rent, tenancy terms and obligations remain between landlord and resident.
- Resident records and maintenance requests are the landlord's records about their own tenancy, and must be kept and used lawfully.
11. AI features
FINDR includes AI assistants (for example Feria, Study Buddy and FINDR Coach). AI-generated content can be inaccurate or incomplete:
- AI answers are provided for information and convenience only. FINDR Coach's business suggestions are not professional financial, tax or legal advice, and Study Buddy is a study aid, not a substitute for instruction.
- Check important information before relying on it; you remain responsible for your decisions.
12. Content you provide
You keep ownership of content you upload (e.g. photos, listings, reviews), and grant FINDR a non-exclusive, worldwide licence to host, display and use it to operate and promote the service. You're responsible for having the rights to what you upload.
13. Service availability
FINDR is provided on an "as is" and "as available" basis. We don't guarantee that the service will be uninterrupted, error-free, or that listings, fares or availability are always accurate. We may change, suspend or discontinue features at any time.
14. Limitation of liability
To the fullest extent permitted by law, FINDR and Feria Information Systems (FIS) are not liable for the acts, omissions, goods or services of independent drivers, couriers, businesses, skilled workers, tutors, schools or landlords, nor for indirect, incidental or consequential losses. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15. Indemnity
You agree to indemnify FINDR against claims arising from your misuse of the service, your content, or your breach of these Terms or of any law or third-party right.
16. Suspension & termination
We may suspend or terminate your access if you breach these Terms or to protect users, the public or FINDR. You may stop using FINDR and delete your account at any time.
17. Changes to these Terms
We may update these Terms from time to time. We'll post the updated version here with a new "last updated" date, and your continued use after changes means you accept them.
18. Governing law
These Terms are governed by the laws of the Republic of Ghana, and disputes are subject to its courts.
